GOODSEND VIP Circle Promotional, Benefits and Discounts

Terms and Conditions
  1. Parties, application and acceptance

1.1 These GOODSEND VIP Circle Promotional Terms and Conditions form a binding agreement between Ahhsemble Pty Ltd trading as GOTSENT ABN 73 691 272 303 referred to as GOTSENT, we, us, our and each individual who registers for, accesses or uses the GOODSEND VIP Circle referred to as you, your, customer or VIP Member.

1.2 By registering for the GOODSEND VIP Circle, remaining subscribed, accessing any VIP benefit or completing a purchase where a VIP benefit is applied, you acknowledge that you have read, understood and agree to be bound by these terms.

1.3 These terms apply in addition to our Website Terms and Conditions, Privacy Policy, Shipping Policy, Returns Policy and any other policies published on our website. If there is any inconsistency, these GOODSEND VIP Circle Promotional Terms and Conditions prevail only to the extent of VIP benefits.

  1. Definitions and interpretation

In these terms, unless the context otherwise requires:

Active Member means a VIP Member who remains subscribed to GOODSEND VIP Circle communications and whose membership has not been suspended or terminated.

ACL means the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 Cth.

Eligible Products means products or services designated by us as eligible for VIP benefits from time to time.

Final Checkout Total means the total amount payable at checkout after all pricing adjustments, promotions, discounts, credits and VIP benefits have been applied, inclusive of GST.

GOODSEND VIP Circle means the customer loyalty and promotional program operated by GOTSENT.

One-Time Welcome Discount means the fifteen percent discount described in clause 5.1.

Ongoing VIP Discount means the five percent discount described in clause 5.2.

  1. Eligibility and ongoing membership requirements

3.1 VIP benefits are available only to Active Members of the GOODSEND VIP Circle.

3.2 To be considered an Active Member, you must successfully complete the GOODSEND VIP Circle sign-up process, provide a valid and unique email address, remain subscribed to VIP communications at the time of purchase and use the same email address at checkout as the one registered to your VIP membership.

3.3 If you unsubscribe from GOODSEND VIP Circle communications, your eligibility for VIP benefits may cease immediately or within a reasonable processing period.

3.4 VIP benefits are personal, non-transferable and may not be sold, assigned, shared or used for resale, wholesale or commercial purposes unless expressly approved by us in writing.

  1. VIP benefits generally

4.1 Active Members may be eligible to receive certain benefits offered by GOTSENT from time to time.

4.2 VIP benefits may include, but are not limited to, discounts, early or priority access to product launches or limited releases, access to exclusive products, variants, colourways or bundles, advance notice of promotions or events, invitations to private drops or VIP-only experiences and discretionary gifts or perks.

4.3 The availability, nature, duration and conditions of any VIP benefit are determined by us at our sole discretion and may vary between members, campaigns or time periods.

4.4 We do not guarantee that any VIP benefit will be available at all times or for any minimum duration.

  1. VIP discount mechanics

5.1 One-Time Welcome Discount 15 Percent Off

(a) Subject to these terms, Active Members who have completed at least one prior purchase may be eligible to receive a one-time fifteen percent discount on their next eligible order.

(b) The One-Time Welcome Discount may only be used once per customer, is issued at our discretion, may be limited to specific customer segments, applies to Eligible Products only and cannot be reused, reinstated or applied retrospectively.

(c) The One-Time Welcome Discount applies to product prices only and does not automatically apply to shipping fees, taxes, duties, gift cards, store credit, stored-value products, gift wrapping, custom services or any products or services we designate as excluded.

5.2 Ongoing VIP Discount 5 Percent Off

(a) Subject to these terms, Active Members may receive an ongoing five percent discount on Eligible Products.

(b) The Ongoing VIP Discount applies automatically at checkout when membership is verified and remains available while the customer remains an Active Member.

(c) The Ongoing VIP Discount may apply in conjunction with promotional pricing, sale pricing or other offers where permitted and unless expressly stated otherwise for a particular promotion.

(d) The Ongoing VIP Discount may be amended, suspended or withdrawn at our discretion.

  1. Stackability with other promotions

6.1 The One-Time Welcome Discount does not stack with any other discount codes, automatic discounts, promotional discounts or VIP benefits unless expressly stated otherwise by us.

6.2 The Ongoing VIP Discount may stack with promotional pricing, sale pricing or other eligible offers unless a promotion expressly states that it cannot be combined with other offers.

6.3 Where multiple discounts or benefits are available, the eligibility, order and method of application are determined by our checkout system and subject to system limitations.

6.4 If an offer states that it cannot be combined with other offers, the Ongoing VIP Discount will not apply unless we expressly state otherwise.

6.5 You acknowledge that discount application order, rounding or calculation outcomes are determined by our checkout system and may vary.

  1. Exclusions, limits and misuse

7.1 We may exclude products, collections, variants, bundles, collaborations, limited editions or services from VIP eligibility at any time.

7.2 We may impose reasonable limits including per order, per customer, per household or per promotional period.

7.3 We reserve the right to suspend or terminate VIP benefits where we reasonably believe there has been misuse, abuse, fraud, attempted circumvention or breach of these terms or any other website policy.

  1. Pricing, GST and errors

8.1 All prices are shown in Australian dollars unless otherwise stated and are GST inclusive where applicable.

8.2 We reserve the right to correct pricing, typographical or system errors and may cancel affected orders and refund amounts paid, subject to the ACL.

  1. Changes, suspension and termination

9.1 We may amend, suspend or terminate the GOODSEND VIP Circle, any VIP benefit, discount, eligibility requirement or stackability condition at any time.

9.2 Any unused or unredeemed VIP benefits are forfeited upon suspension or termination.

  1. Liability and consumer guarantees

10.1 Nothing in these terms excludes any rights or remedies available under the Australian Consumer Law that cannot lawfully be excluded.

10.2 To the maximum extent permitted by law, we are not liable for any indirect or consequential loss arising from participation in the GOODSEND VIP Circle.

  1. Force majeure

11.1 We are not responsible for any delay, failure or interruption to VIP benefits caused by events beyond our reasonable control including natural disasters, pandemics, supply chain disruptions, carrier delays, cyber incidents, system outages, labour disputes or government actions.

  1. Governing law

12.1 These terms are governed by the laws of Victoria, Australia.
12.2 The courts of Victoria have exclusive jurisdiction.
