OdbO™ Prize Terms & Conditions

These OdbO™ Prize Terms & Conditions apply to OdbO™ prize claims, giveaways, competitions, campaigns, collaborations, events and promotions operated by or on behalf of OdbO, GOTSENT and Ahhsemble Pty Ltd.

By entering an OdbO™ promotion, accepting an OdbO™ prize, receiving an OdbO™ claim code or submitting an OdbO™ prize claim form, you agree to these Terms & Conditions.

These Terms & Conditions are intended to apply alongside any campaign, event, giveaway, collaboration or promotion details published at the time of the promotion. If there is any inconsistency between these Terms & Conditions and the specific promotional details, the specific promotional details will apply to the extent of the inconsistency.

1. Promoter

The promoter is OdbO™, a registered business name operated by Ahhsemble Pty Ltd.

GOTSENT is also operated by Ahhsemble Pty Ltd.

For the purposes of these Terms & Conditions, references to “OdbO”, “GOTSENT”, “Ahhsemble”, “we”, “us” or “our” mean OdbO™, GOTSENT and Ahhsemble Pty Ltd, as applicable.

2. Application Of These Terms

These Terms & Conditions apply to OdbO™ prizes offered through campaigns, events, giveaways, collaborations, social media promotions, brand partnerships, public relations activities, launch activities, retail promotions or any other promotional activity conducted by or on behalf of OdbO, GOTSENT or Ahhsemble Pty Ltd.

Each promotion may include additional details, including but not limited to:

• the name of the campaign, event, giveaway or promotion;
• the promotional period;
• the eligibility requirements;
• the prize or prize pool;
• the method of entry;
• the method of winner selection;
• the date winners are selected or notified;
• the claim process;
• the claim deadline;
• any applicable delivery conditions;
• any applicable permit, authority or approval details;
• any additional conditions that apply to that specific promotion.

These additional details form part of the applicable promotion terms.

3. Eligibility

Prize claims are valid for eligible OdbO™ campaign, event, giveaway, collaboration or promotion winners only.

Eligibility requirements may vary depending on the promotion and will be stated in the relevant promotional material where applicable.

Unless otherwise stated, entrants and winners must:

• provide true, accurate and complete information;
• be legally able to participate in the promotion in their location;
• comply with these Terms & Conditions and any campaign-specific requirements;
• not use fraudulent, automated, misleading or unauthorised methods to enter, claim or participate.

Employees, contractors, officers and immediate family members of Ahhsemble Pty Ltd may be excluded from certain promotions where required by law or where stated in the relevant promotion.

We may request proof of identity, proof of age, proof of eligibility, proof of entry or other information reasonably required to verify a winner or prize claim.

4. Entry Conditions

The method of entry for each promotion will be stated in the relevant promotional material.

Unless otherwise stated, entry into an OdbO™ promotion is free.

Where a promotion requires an action such as following a social media account, commenting, submitting a form, attending an event, subscribing, registering interest, making a purchase or completing another activity, the required action will be stated in the relevant promotional material.

Entries must be submitted within the stated promotional period. Late, incomplete, incorrect, illegible, corrupted, fraudulent or non-compliant entries may be deemed invalid.

We are not responsible for entries that are lost, delayed, misdirected, incomplete, incorrectly submitted or not received due to technical issues, internet issues, platform issues, human error or circumstances outside our reasonable control.

5. Chance-Based And Skill-Based Promotions

OdbO™ promotions may be conducted as chance-based promotions, skill-based promotions, event prizes, selected giveaways, collaboration rewards or other promotional activities.

For chance-based promotions, winners may be selected by random draw or another stated method of chance.

For skill-based promotions, winners may be selected based on criteria such as creativity, originality, relevance, quality of response, brand alignment or another stated judging method.

Where judging is involved, the decision of OdbO, GOTSENT, Ahhsemble Pty Ltd or the appointed judges is final, subject to applicable law.

No correspondence will be entered into regarding the selection process except where required by law.

6. Claim Codes

A valid claim code may be required to verify a prize claim.

Claim codes must be entered exactly as shown on the winner letter, prize card, email, message, campaign communication or other official OdbO™ communication.

One claim code may be used per eligible prize winner unless otherwise stated.

Claim codes are unique to the intended winner and must not be transferred, sold, exchanged, copied, shared publicly or used by another person without written approval from OdbO, GOTSENT or Ahhsemble Pty Ltd.

We may reject a claim code if we reasonably believe it has been used fraudulently, duplicated, altered, obtained without authorisation, shared publicly, transferred without approval or used in breach of these Terms & Conditions.

7. Prize Details

The prize available to each winner will be the prize stated in the relevant campaign, event, giveaway, collaboration or promotion.

Prizes may include, but are not limited to:

• OdbO™ Starter Kits;
• Emotion Patch Sets;
• OdbO™ merchandise;
• digital rewards;
• launch rewards;
• collaboration prizes;
• gift cards, vouchers or other stated items;
• other prizes confirmed in writing by OdbO, GOTSENT or Ahhsemble Pty Ltd.

Prize images, mockups, samples, renders, prototypes, campaign visuals or promotional materials are for illustrative purposes only unless otherwise stated. Final prize appearance, packaging, colours, inclusions, format or presentation may vary.

Prizes are not redeemable for cash, credit, refund, exchange or other alternatives unless required by law or confirmed by us in writing.

Prizes must not be resold for commercial purposes without written approval from OdbO, GOTSENT or Ahhsemble Pty Ltd.

8. First Release, Prelaunch And Product Availability

Some OdbO™ prizes may relate to products that are in First Release preparation, prelaunch, preorder, production, manufacturing, fulfilment planning or staged release.

Where this applies, the prize may not be available for immediate delivery at the time the winner is announced or the claim is submitted.

Delivery or fulfilment will take place once the relevant prize product is ready, available and approved for fulfilment.

Any estimated delivery or fulfilment date provided is an estimate only and may be subject to change due to production timelines, supplier schedules, testing, quality control, packaging, freight, customs, fulfilment partners, delivery partners or circumstances outside our reasonable control.

We will make reasonable efforts to keep verified winners informed of material fulfilment updates where relevant.

9. Prize Availability And Substitution

We will make reasonable efforts to provide the stated prize to each verified eligible winner.

If a prize, prize component, colour, design, edition, accessory or inclusion becomes unavailable for reasons outside our reasonable control, we may substitute it with a reasonable alternative of equal or greater value, where permitted by law.

A substituted prize may differ in design, colour, edition, packaging, format or other details, but will be selected in good faith to reflect the original promotional intent as closely as reasonably possible.

10. Prize Claim Process

To claim a prize, winners may be required to complete the OdbO™ Prize Claim form or follow another claim process stated in the relevant promotion.

The winner may be required to provide:

• full name;
• email address;
• phone number;
• claim code;
• campaign, event or promotion name;
• prize won;
• delivery address;
• any delivery instructions;
• any additional information reasonably required to verify the claim or arrange fulfilment.

Submitting a prize claim does not automatically confirm entitlement to a prize. All prize claims are subject to verification.

11. Claim Deadline

A claim deadline may apply to each promotion.

Where a claim deadline is stated, the winner must submit the required claim information before the deadline.

If a winner does not claim their prize by the stated deadline, provides incomplete information, cannot be contacted, does not respond within a reasonable time or is found to be ineligible, the prize may be forfeited, withdrawn or awarded to another eligible entrant, where permitted by law.

Where no specific claim deadline is stated, winners should claim their prize as soon as reasonably possible after being notified.

12. Verification And Refusal Of Claims

We may verify the identity, eligibility and claim details of any entrant or winner.

We may reject, cancel, suspend or refuse a prize claim if we reasonably believe that:

• the claim code is invalid;
• the claim is duplicate;
• the claimant is not the eligible winner;
• the information provided is false, incomplete, misleading or inaccurate;
• the claim is connected to fraud, misuse, error, technical manipulation or unauthorised activity;
• the entrant or winner has breached these Terms & Conditions;
• the entrant or winner has acted in a way that is abusive, threatening, harmful, unlawful, misleading or damaging to OdbO, GOTSENT, Ahhsemble Pty Ltd, our partners or other participants;
• the claim cannot be verified after reasonable attempts.

We may request further information before approving a claim.

13. Lost, Damaged Or Missing Claim Codes

Winners are responsible for keeping their claim code safe.

If a claim code is lost, misplaced, damaged or deleted, we may not be able to verify the prize claim unless the winner can provide other reasonable proof of eligibility.

Replacement claim codes may be issued at our discretion.

We are not responsible for claim codes that are lost, stolen, shared, misused, copied, accessed by another person or submitted incorrectly.

14. Delivery

Where a prize requires delivery, the winner must provide accurate and complete delivery details.

We are not responsible for delivery delays, failed delivery, returned parcels, lost parcels or non-delivery caused by incorrect, incomplete or outdated information provided by the winner.

If delivery details change after a claim is submitted, the winner must contact us as soon as possible.

Delivery may be limited to the regions, countries or addresses stated in the relevant promotion.

Unless otherwise stated, prizes will be delivered using a delivery method selected by us or our fulfilment partners.

Risk in the prize may pass to the winner once the prize is delivered to the address provided or otherwise made available for collection, subject to applicable consumer laws.

15. International Winners

Some OdbO™ promotions may be limited to Australia or selected regions only.

Where international participation is permitted, the winner is responsible for ensuring they can lawfully receive the prize in their location.

International delivery may be subject to restrictions, delays, customs processes, duties, taxes, import requirements or local laws.

Unless otherwise stated, we are not responsible for customs duties, import taxes, local charges, additional delivery fees or other costs imposed by third parties or local authorities.

If a prize cannot be lawfully, reasonably or practically delivered to a winner’s location, we may offer an alternative arrangement, substitute prize or withdrawal of the prize, where permitted by law.

16. Social Media Promotions

Some promotions may be conducted through social media platforms, including but not limited to Instagram, Facebook, TikTok, YouTube or other platforms.

Unless expressly stated otherwise, OdbO™ promotions are not sponsored, endorsed, administered by or associated with Instagram, Facebook, TikTok, YouTube, Meta or any other social media platform.

Entrants and winners release the relevant social media platform from any liability connected with the promotion, to the extent permitted by law.

Entrants must comply with the applicable platform rules, community guidelines and terms of use.

We are not responsible for platform outages, account restrictions, deleted posts, hidden comments, direct message issues, algorithmic visibility, impersonator accounts or other platform-related issues outside our reasonable control.

17. Publicity And User Content

We may ask winners whether they would like to share feedback, photographs, videos, testimonials, comments or other content about their prize experience.

Participation in publicity, testimonials or promotional content is optional unless clearly stated as part of a skill-based entry requirement.

We will not use a winner’s image, likeness, personal story, testimonial or identifiable content in marketing without permission, except where permitted by law or where the winner has already submitted public content as part of the promotion.

If an entrant submits content as part of a promotion, they confirm that the content is their original work, does not infringe the rights of any other person and does not contain unlawful, offensive, misleading, harmful or inappropriate material.

By submitting promotional content, entrants grant OdbO, GOTSENT and Ahhsemble Pty Ltd a non-exclusive, royalty-free licence to use, share, repost or display that content for purposes connected with the promotion, unless otherwise stated.

18. Personal Information And Privacy

Information submitted through the OdbO™ Prize Claim form or any related promotion will be used to:

• verify the prize claim;
• confirm eligibility;
• contact the winner where required;
• reserve the prize;
• arrange fulfilment or delivery;
• administer the promotion;
• comply with legal obligations;
• protect against fraud, misuse or unauthorised claims.

If the winner chooses to opt in to marketing, they may also receive email updates, launch news and offers from OdbO and GOTSENT.

Marketing consent is optional. Winners can unsubscribe from marketing communications at any time.

Personal information will be handled in accordance with our Privacy Policy.

We may share necessary information with service providers, delivery partners, fulfilment partners, campaign partners, technology providers or professional advisers where reasonably required to administer the promotion or fulfil the prize.

19. Marketing Consent

Submitting a prize claim does not automatically subscribe a winner to marketing communications.

Where a marketing consent checkbox is provided, winners may choose whether to receive updates, launch news and offers from OdbO and GOTSENT.

If a winner opts in, they can unsubscribe at any time using the unsubscribe link in the email or by contacting us.

20. Errors, Technical Issues And Interference

If a promotion, claim process, website, form, draw, judging process or fulfilment process is affected by error, technical failure, unauthorised intervention, fraud, tampering, platform issue, supplier issue, system failure or any event outside our reasonable control, we may take reasonable action to protect the integrity of the promotion.

This may include verifying entries, rejecting affected claims, suspending the promotion, modifying the claim process, delaying fulfilment, selecting a replacement winner or cancelling the promotion, subject to applicable law.

We are not liable for any loss, damage, delay or issue caused by technical problems, platform restrictions, internet failures, unauthorised access, data loss, human error or third-party service failures outside our reasonable control.

21. Liability

Nothing in these Terms & Conditions limits, excludes or modifies any consumer guarantee, statutory right or other protection that cannot be excluded under Australian Consumer Law or other applicable laws.

To the maximum extent permitted by law, OdbO, GOTSENT and Ahhsemble Pty Ltd are not liable for any loss, damage, injury, delay, cost or expense arising from or connected with:

• participation in a promotion;
• use or misuse of a prize;
• incorrect or incomplete information provided by a winner;
• delivery delays or failed delivery;
• third-party services or platforms;
• circumstances outside our reasonable control.

Winners are responsible for using any prize safely, appropriately and in accordance with any product instructions, age guidance, warnings or care information provided.

22. Health, Wellbeing And Product Positioning

OdbO™ is a collectible comfort companion created for emotional reflection, tactile grounding and quiet moments of pause.

OdbO™ is not a medical device, therapy tool, treatment, crisis support service or substitute for professional care, medical advice, diagnosis or treatment.

Any wellbeing-related language used in connection with OdbO™ is intended to describe comfort, reflection, grounding and emotional support in a general, non-clinical sense.

23. Disqualification

We may disqualify an entrant or winner if we reasonably believe they have:

• breached these Terms & Conditions;
• provided false, misleading or incomplete information;
• used an invalid or unauthorised claim code;
• attempted to manipulate, interfere with or abuse the promotion;
• used automated, bulk, fake or fraudulent entries;
• impersonated another person;
• acted unlawfully, abusively or harmfully;
• damaged or attempted to damage the reputation, systems, accounts or operations of OdbO, GOTSENT, Ahhsemble Pty Ltd or our partners.

24. Decisions

All reasonable decisions made by OdbO, GOTSENT or Ahhsemble Pty Ltd in relation to eligibility, verification, prize claims, fulfilment and administration of a promotion are final, subject to applicable law.

25. Changes To Promotions

We may modify, suspend, cancel, delay or withdraw a promotion where reasonably necessary due to circumstances outside our reasonable control, legal requirements, platform issues, technical issues, fraud, supplier issues, product availability, fulfilment issues or other material operational reasons.

Where required, any changes will be made in accordance with applicable laws and regulatory requirements.

26. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Entrants and winners submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

Where a promotion is open to entrants in other Australian states, territories or international locations, any additional mandatory local laws may also apply.
